The website www.services-rte.com is referred to below as the SERVICES Portal.

The website www.data.rte-france.com is referred to below as the DATA Portal.

The term "PORTALS" refers to the SERVICES Portal and the DATA Portal.

Legal notice:

The PORTALS are the property of RTE Réseau de Transport d'Électricité, a public limited company with a Management Board and a Supervisory Board, registered with the Nanterre Trade and Companies Register, under the number 44461925802482, whose registered office is located at Immeuble WINDOW, 7C Place du Dôme, 92073 PARIS LA DEFENSE CEDEX.

The PORTALS are hosted in France by RTE.

RTE has therefore decided to make the PORTALS available under the terms and conditions defined in these General Terms of Service.

In this context, RTE and the User (defined in Article 15 "Definitions") agree as follows.

Article 1 - Purpose of these General Terms of Service

The purpose of these General Terms of Service (GTS) is to define the terms and conditions under which Users may access the PORTALS and use the data available in the form of public or partner APIs (Private Data), as well as in download form.

Anyone accessing Information and/or Services via the PORTALS undertakes to unconditionally comply with these GTS, which they have accepted under the conditions defined in Article 2. The contractual framework governing the use of and access to the PORTALS and consists of the following contractual documents in order of priority:

  • these General Terms of Service (GTS);
  • the IS rules;
  • the IS annexes;
  • the user guide

Article 2 - Acceptance of the GTS

In order to use the Services provided on the PORTALS, the User must first accept these General Terms of Service (GTS). This acceptance by the User is implemented under the conditions defined below:

2.1 Acceptance of the GTS for the DATA Portal

On the DATA Portal, acceptance of the GTS by the User is implemented:

  • during the activation of the Administrator Account (an account created by RTE as part of the process defined in Article 4.1) by ticking a box;
  • during the activation of the Administrator Account by the customer Administrator (as part of the process defined in Article 4.1) by ticking a box;
  • during the process of subscribing to an API when clicking on the "Subscribe" button. In order to ensure that the User is familiar with the GTS, the following notice appears: "By clicking on the 'Subscribe' button, I accept the GTS, which you can read by clicking here".
2.2 Acceptance of the GTS for the SERVICES Portal

On the SERVICES Portal, acceptance of the GTS by the User is implemented as part of the process defined in Article 4.1:

  • during the activation of the Administrator Account (an account created by RTE);
  • during the creation of a User Account by an Administrator;
  • during the creation of an Administrator Account by an Administrator;

Article 3 - Modification of the General Terms of Service

RTE reserves the right to modify all or part of these General Terms of Service at any time, and in particular to reflect any legal, jurisprudential, editorial and/or technical developments.

Modifications made to the GTS will be notified to the User on the PORTALS by displaying a banner or by email (the email address used will be the address entered when creating the User Account or the Administrator Account). The new GTS must be accepted by the User before any subsequent operation on the PORTALS.

Any new General Terms of Service applicable to the Services provided on the PORTALS shall supersede the previous GTS in all their effects.

Without prejudice to the preceding provisions, the User is requested to consult these General Terms of Service and to save them on a durable medium.

Article 4 - Registration and account creation

4.1 Account creation

To access the Information and the Private Data Services available on the PORTALS, a Customer Company must declare a primary Administrator in charge of managing access and customising the Data Services available on the PORTALS.  For this purpose, and after a Customer Company’s demand

RTE shall create the Administrator Account by generating an activation email on the primary Administrator's email account. To finalise the creation of the account, the primary Administrator must confirm the accuracy of the information provided to RTE, validate these GTS and create a password (for the DATA portal, the GTS are validated during the completion of the primary Administrator's declaration form). When the Administrator Account is created and used by a person acting in the name and on behalf of a Customer Company, this person declares and guarantees RTE that she has the necessary powers and capacity to represent and engage the Customer Company under the conditions set forth in these GTS.

For the SERVICES Portal, and in accordance with the terms and conditions defined in Article 5.1, an Administrator of a Customer Company may:

  • create other Private User Accounts linked to the Customer Company in question by indicating the email address of the future beneficiary of the User Account in the appropriate section on the SERVICES portal. The latter will receive an Online Account creation request by email, which must be validated on the SERVICES portal, by providing a password and agreeing to accept the GTS. If the account request is not validated, RTE will send out a follow-up email at the earliest opportunity;
  • convert a Private User Account linked to the Customer Company in question into an Administrator Account for that Customer Company via a function available on the SERVICES Portal;
  • link a Public User Account to the Customer Company in question after obtaining the consent of the User of the account.
  • link a Public User Account, itself already linked to one or several other Client Companies, to the Client Company in question once they have obtained the consent of the User concerned.

For the DATA Portal, and in accordance with the terms and conditions defined in Article 5.1, an Administrator of a Customer Company may:

  • create other Private User Accounts linked to the Customer Company in question by indicating the email address of the future beneficiary of the User Account in the appropriate section on the DATA portal. The latter will receive an Online Account creation request by email, which must be validated on the SERVICES portal, by providing a password and agreeing to accept the GTS;
  • convert a Private User Account linked to the Customer Company in question into an Administrator Account for that Customer Company via a function available on the DATA Portal.

To access the information and Public Data Services available on the PORTALS, the User can directly create a Public User Account by completing a registration form on the PORTALS. When registering online, the User undertakes to provide accurate, up-to-date and complete information required for the creation of an Online Account. In particular, the User undertakes not to create a false identity that would mislead RTE or third parties and not to impersonate another legal or natural person.

In the event a User turns Public User Account into a Private User Account, he undertakes to respect the General Terms and Conditions of Use regarding the creation and use of a Private User Account.

In the event that the User should provide false, inaccurate, outdated, incomplete, deceptive or misleading information, RTE may immediately suspend or terminate access to the PORTALS without prior notice or indemnity, and deny access temporarily or permanently to all or part of the Services.

4.2 Technical requirements for connection (Online Account, authentication for access to APIs)

RTE shall provide the User with the technical requirements for connection (login and password) permitting him or her to manage the User Account or Administrator Account:

  • In the case of an Administrator Account, the profile is pre-filled by RTE. The Administrator then receives an activation email enabling him or her to enter a password;
  • In the case of a Private Administrator Account, the profile is pre-filled by RTE. The Administrator then receives an activation email request to create a password;

For a connection providing access to Public Data, the login and password are created by the User via a form available on each of the PORTALS.

If the password is lost, it can be reset by entering the email address that was used to create the account. This feature is accessible by clicking on the "Forgot your password?" link on the login page of each PORTAL.

For access to APIs, OAuth 2.0 logins corresponding to one of the OAuth 2.0 flows proposed by RTE are visible directly on the DATA portal. These logins are supported by an application declared by the User on the DATA Portal. By declaring an application, a User can subscribe to an API with respect to this application. These logins can be reset at the User's initiative on the DATA Portal.

Article 5 - Portal access and functioning 

5.1 - Right granted to the User

The User is solely responsible for all activity conducted via his or her User Account or Administrator Account. A holder of a User Account for the SERVICES Portal may manage his or her Personal Data and preferences in connection with the SERVICES. In addition to the rights granted to a User Account, a holder of an Administrator Account on the SERVICES Portal may:

  • Declare new Private User Accounts (linked to the Administrator's Customer Company) and manage their access to the Services;
  • Unlink Private User Accounts from their company, converting them into Public User Accounts if they are no longer linked to any company;
  • Customise the Services subscribed by and on behalf of the Customer Company.

5.2 - Accessibility and description of the Services available on the PORTALS

The services available on the SERVICES Portal can be accessed by connecting via a login and password.

The services available on the SERVICES Portal allow Users to engage in data management, including viewing and entering data and downloading files.

The DATA portal can be accessed by connecting via a login and password. The services (APIs) visible from the DATA Portal can be accessed via an OAuth 2.0 authentication system (using assigned connection logins of the TOKEN type).

These services (APIs) provide access to Public or Private Data through APIs.

Article 6 - Duration and termination

The Services available on the PORTALS are provided by RTE for an indefinite period.

The User expressly acknowledges that RTE has the right to terminate access to the Services made available on the PORTALS automatically and by right, without formal notification and without prior notice, indemnity or justification.

Users holding a User Account may terminate their use of PORTALS via their profile management page.

Users warrant RTE, following termination of access to the Private Data Services provided, that they will cease to use the data hosted on the PORTALS or via the APIs in any manner whatsoever, and if a right of access was granted to another User by their doing, they undertake to withdraw access to the Private Data Services from said User.

In order to ensure continuity of service, each Company wishing to access its Private Data via the SERVICES Portal or the DATA Portal must have at least one Administrator who is a natural person. It is specified that Users may not delete their Administrator Account of their own initiative. To delete their Administrator Account, the User must request that it be deleted by another Administrator of the same Customer Company.

Article 7 - Use of and access to the services 

7.1 - Obligations of the User

Any use of and/or access to the Services made available on the PORTALS must be implemented in accordance with these General Terms of Service. Any other use requires the prior and express consent of RTE.

The User:

  • Shall refrain from any action that could be prejudicial to RTE and/or other Users;
  • Shall refrain from any use of the PORTALS and Services available on the PORTALS that is contrary to applicable laws and regulations and/or violates the rights of third parties, including intellectual property rights and/or the right to privacy;
  • Shall not jeopardise, obstruct or alter the proper functioning of the PORTALS or the Services available on the PORTALS, or make use of the PORTALS in any manner that could be prejudicial to the rights of other Users, third parties or RTE;
  • Shall not circumvent any means implemented by RTE to ensure security of access to the Services made available on the PORTALS, or to the PORTALS themselves and their functioning;
  • Shall refrain from using any means intended to circumvent the technical identification procedures implemented by RTE;
  • Is not authorised to reconstitute all or part of the PORTALS, or the content of the Services made available on the PORTALS, over which no rights are granted.
7.2 - Use restrictions by RTE

In the event of a violation of the GTS, RTE reserves the right to interrupt access to the DATA Portal, the SERVICES portal, the APIs and the Information and services made available on the PORTALS (defined in Article 5), at any time, either partially or totally, without engaging RTE's liability. With regard to the APIs, RTE reserves the right to suspend User access subsequent to finding evidence of uses not in conformity with the Development Guide (attached to each API's ID sheet), altering the accessibility, availability, maintenance or operation of the RTE Information System (IS).

Article 8 - Liability

It is expressly understood that RTE does not exercise any control over the User's management of his/her Personal and Private Data, and may not be held liable in any way for the aforementioned data or links with other data provided under the sole responsibility of the User.

RTE shall not be held liable for errors, negligence, failure or omission(s) caused by the User in their use of and access to the PORTALS, or for lack of availability of the Services available on the PORTALS.

The User may be held liable for any unauthorised use of the PORTALS, APIs and Services made available on the PORTALS, as well as for information and data disclosed during said use.

Except as otherwise expressly required by law, RTE shall not be held liable for any damage directly or indirectly related to the use of and access to the PORTALS or the APIs by reason of direct or indirect material or immaterial damages, including loss of profit, loss of luck, loss of customers, loss of data, loss of image and/or intangible damages suffered by the User.

Article 9 - Ownership of the content accessible on the portals 

All information, data or documents hosted on the PORTALS as well as all elements created for the PORTALS are either the property of RTE or are covered by a right of use, exploitation and reproduction.

Data published on the PORTALS and not requiring the creation of a User Account by an Administrator, including data accessible via an online account created by a User, are deemed "public" (i.e. "Public Data"). Re-use of Public Data is permitted provided that the source is mentioned. However, modification, or total or partial distortion of the PORTALS or their content, by any process whatsoever and on any support whatsoever, is prohibited. Any use of this data is the sole responsibility of the User. RTE shall not be held liable for any fraudulent use of the data.

Data published on the PORTALS, corresponding to data from a customer's (Customer Company) service perimeter, made available to the User are private (i.e. "Private Data").

RTE trademarks and logos appearing on the PORTALS are protected. Any reproduction or representation of said trademarks or logos, alone or associated with other elements, without the express prior authorisation of RTE is prohibited and the User shall incur liability under the terms of Articles L. 713-2 and L. 713-3 of the French Intellectual Property Code.

Without prejudice to the provisions of this article, all data accessible via the wholesale_market API or via the "Electricity Exchange" ("Power exchange data") shall be the exclusive property of Epex Spot SE and Nord Pool AS or its subsidiaries. However, the User is authorised to download, print and use said data made available for internal and/or personal use provided that the source and the owner are indicated.

Any other use of Power exchange data by the User is strictly prohibited without the written consent of Epex Spot SE and Nord Pool AS, including:

  • any commercial use,
  • the creation of any financial instrument or reference index for external use or for the benefit of third parties,
  • copying, distribution, marketing, exploitation or use with or for the benefit of third parties.

The user acknowledges his responsibility towards Epex Spot SE and Nord Pool AS for compliance with these general terms of service by its employees, officers, service providers. 
Epex Spot SE reserves the right to audit the use of data by the user.

Article 10 - Cookies and website traffic statistics 

Cookies are small data files used to record information relating to the User's navigation on the PORTALS.

Users are informed that during their visits to the website, a session cookie may be automatically installed in their browser software. When creating their online account, Users must agree to the use of session cookies allowing RTE to authenticate their presence during navigation. Session cookies on the PORTALS are automatically deleted after thirty (30) minutes of inactivity.

Users are informed of their option of blocking other types of cookies, in particular those concerning website traffic statistics for the PORTALS (Google Analytics), by configuring their browser accordingly. An information banner to that effect will appear on their browser when they log on to the PORTALS.

Finally third-party cookies may be included on the PORTALS, via computer applications from third parties, which allow Users to share the content of our PORTALS. This is the case for the "Share" and "Like" buttons from social networks such as Facebook, Twitter, LinkedIn, etc.

RTE has no control over the process used by the social networks to collect information relating to navigation on the PORTALS and associated with the personal data at their disposal. For more information, Users should consult the privacy policies of these social networks in order to find out why they are used and the types of browsing information they may gather through these application buttons.

Article 11 - Hyperlinks

Hyperlinks to other resources on the Internet (and to partners in particular), placed in connection with the PORTALS, were previously and expressly authorised.

However, since RTE is not the publisher of these resources, it is has no control over their content. Accordingly, in no event may RTE be held liable for the content of the PORTALS accessible via these links, or for the collection and transmission of personal data, installation of cookies or any other process for the same purposes carried out by these PORTALS.

Article 12 - Disclaimer of warranty 

The PORTALS are accessible 24 hours a day, 7 days a week. RTE undertakes to provide all necessary and reasonable means to ensure continuous access to the PORTALS and to the Services provided on the PORTALS (defined in Article 5), subject to compliance by the User with these General Terms of Service.

RTE will use its best efforts to warn the User in case of technical contingencies and of any resulting interruptions of access (due to maintenance, computer problems, network problems or other technical difficulties) without however committing to a timeframe. Consequently, RTE may not be held liable for any unavailability, slowdowns, suspensions or difficulties in accessing the services defined in Article 5.

Article 13 - Electronic communication

All notifications or any other communication between the User and RTE may be made by any electronic means.

RTE may communicate information to the User by any electronic or dematerialised means that may be linked directly or indirectly to the PORTALS or to the Services provided on the PORTALS.

Article 14 - Applicable law and dispute resolution

These General Terms of Service (GTS) are governed by French law.

Given the nature of their exchanges and, in particular, the dematerialisation of the relationship between the User and RTE, it is agreed that all computer records in the RTE information system shall have evidentiary value in the event of a dispute.

For any dispute concerning the formation, execution, interpretation, validity, termination or cancellation of these General Terms of Service, exclusive jurisdiction is granted to the competent courts under the jurisdiction of the Court of Appeal of Paris (France).

Article 15 - Definitions

IS annex(es): Annexes to the IS Rules defining the characteristics of the Applications and the special terms and conditions of their use. There is an Application IS Annex for each Application made available by RTE.

General IS Annex (available here): Annex to the IS rules defining the common conditions applicable to access to and use of the applications of RTE's information system (IS), specifying in particular:

  • Possible means of access to RTE’s information system (IS).
  • Accessible Applications and Methods of Use;
  • Configurations for the User's Hardware supported by RTE for Access to the IS;
  • Usage charter for the Electronic Key.
     

API :  Application Programming Interface,  used to retrieve public or private data by querying RTE's IS via  operations (using the CRUD principle – Create Read Update Delete). Data is accessible via the API using one of the flows proposed by RTE of the OAuth 2.0 authorisation standard.

Application Tierce :  A User may declare an application on the DATA Portal; this declaration is then used to retrieve OAuth 2.0 connection logins and to subscribe to one or more APIs.

GTS : Means these General Terms of Service.

Administrator Account: A type of User Account (see definition below) that gives the holder extended rights, including the right to manage access to the services offered to the company the Administrator represents. In this respect, an Administrator Account is always associated with a company known to RTE.

User Account: A User Account is a set of information that tells RTE what data the User can access, the modifications he or she can make, and their personal preferences.
A User Account may be:

  • Public, when it is not linked to a Customer Company (i.e. Public User Account)
  • Private, when it is linked to a Customer Company (i.e. Private User Account).

Private Data:  Any data created by the User, or held by a legal entity which is contractually linked with RTE.

Public Data: Any data made available to Users of the website with no restriction on access.

EIC: Energy Identification Code – An ENTSO-E ID code used to identify a company.

Development Guide:  A guide for developers on implementing an API in their IS. This guide describes the input, output, and management settings implemented in the API and various resources.

IS rules (available here): Rules specifying the general terms and conditions governing access to RTE's IS and the use of Applications for the execution of the Services.

Service(s): Encompasses all information and services accessible from the PORTALS or via the APIs, as defined in Article 5.

Customer Company: Legal personality identified by an EIC code that benefits from Private Data Services as defined in the contracts binding them with RTE.

User(s):   Any natural person or representative of a legal entity using the PORTALS and/or APIs to access the Services via an electronic communications network.
